1. Acceptance of Terms
By accessing and using the Pocket Rx website (the "Website") and its services (the "Services"), you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this service will constitute acceptance of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
Pocket Rx, owned and operated by Digital Edge Media Group, LLC, provides users with a free prescription discount card service. Users provide their mobile phone number to receive discount card details via SMS. This card can then be presented at participating pharmacies to potentially receive discounts on prescription medications. The service is provided "AS IS" and Pocket Rx assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings. Savings vary and are not guaranteed. This card is not insurance.
3. User Conduct
You agree to use the Website and Services only for lawful purposes. You are solely responsible for all information you input into the service. You agree not to use the service to:
- Provide any false, inaccurate, or misleading information.
- Impersonate any person or entity.
- Violate any applicable local, state, national or international law.
- Interfere with or disrupt the service or servers or networks connected to the service.
You must be 18 years or older to use this service.
4. SMS Communications
By providing your mobile phone number, you consent to receive SMS (text messages) from Pocket Rx containing your Rx discount card details and potentially related administrative messages. Message and data rates may apply. You can opt-out of receiving future messages by replying STOP. Opting out may prevent you from receiving necessary service communications. We will send a maximum of 2 messages per request unless you initiate further interaction.
5. Intellectual Property
The Website and its original content, features, and functionality are owned by Digital Edge Media Group, LLC (operators of Pocket Rx) and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. The Pocket Rx name and logo are trademarks of Digital Edge Media Group, LLC.
6. Disclaimer of Warranties
The service is provided on an "AS IS" and "AS AVAILABLE" basis. Pocket Rx expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Pocket Rx makes no warranty that the service will meet your requirements, or that the service will be uninterrupted, timely, secure, or error-free. No advice or information, whether oral or written, obtained by you from Pocket Rx or through or from the service shall create any warranty not expressly stated in the terms. We do not guarantee any specific discount amount or the acceptance of the card at any particular pharmacy.
7. Limitation of Liability
You expressly understand and agree that Pocket Rx (and its owner, Digital Edge Media Group, LLC) shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Pocket Rx has been advised of the possibility of such damages), resulting from the use or the inability to use the service.
8. Modifications to Terms
Pocket Rx reserves the right, at its sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Website. Your continued use of the Website after any such changes constitutes your acceptance of the new Terms of Service. Please review this Agreement periodically for changes.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of North Carolina, without regard to its conflict of law provisions.
